Quick Summary

aiBlue Core™ is a cognitive infrastructure layer that structures AI reasoning. By using our Service, you agree to these terms. Key points: You own your inputs and outputs. We don't sell your data. The Service is provided "as is" with liability limitations. You must be 18+ (or have parental consent if 13-17). Disputes go to binding arbitration.


1. Accepting These Terms

By using aiBlue Core™ (via web, API, mobile, or enterprise), you agree to these Terms, our Privacy Policy, and any additional enterprise agreements. If using for an organization, you confirm you have authority to bind that organization. Don't agree? Don't use the Service.


2. What aiBlue Core™ Is (and Isn't)

What it is: A cognitive orchestration layer providing structured reasoning, multi-distance processing, constraint adherence, and cognitive stability across AI models (GPT, Claude, Gemini, etc.).

What it's NOT:

  • A standalone AI model
  • A source of guaranteed facts
  • Professional advice (medical, legal, financial)
  • Error-free or infallible

The Core enhances reasoning structure but relies on underlying AI model capabilities and limitations.


3. Who Can Use It

  • Age 18+ (or age of majority in your location)
  • Ages 13-17: Requires parental/guardian consent and involvement
  • Under 13: Not permitted unless through institutional authorization (schools with proper consent)

Your responsibilities:

  • Keep account credentials secure
  • Monitor all account activity
  • Report unauthorized use immediately
  • Keep account information current

4. Acceptable Use

✅ Permitted Uses

Education, business analysis, research, workflow enhancement, policy analysis, creative development, and any lawful purpose.

❌ Prohibited Uses

You may NOT:

  • Violate laws or third-party rights
  • Generate content promoting violence, hatred, discrimination, or harassment
  • Create malware, exploits, or security vulnerabilities
  • Reverse engineer the Core's architecture
  • Impersonate others or misrepresent affiliations
  • Harm, sexualize, groom, or exploit minors
  • Create weapons information (chemical, biological, nuclear)
  • Spam, phish, or engage in fraud
  • Overload or attack our infrastructure
  • Make life-critical decisions (medical, legal, financial, safety systems) without professional oversight
  • Scrape or data-mine without authorization

Violations = immediate suspension/termination, possible legal action.


5. Intellectual Property

Our Rights

The Core's architecture, algorithms, frameworks, designs, and branding are exclusively ours. Protected by copyright, patent, trade secret, and trademark law.

You CANNOT:

  • Reverse engineer or reconstruct the Core
  • Create derivative systems from observed behaviors
  • Use our name/logo without written permission

Your Rights

You own your inputs and outputs. By using the Service, you grant us a limited license to:

  • Process your inputs to provide the Service
  • Use aggregated, anonymized data for improvement
  • Store necessary data

This license ends when you delete content or close your account (except for public content, anonymized data, or legally required retention).

Feedback

If you provide suggestions or feedback, we can use it freely without compensation.


6. Payment (for Paid Tiers)

  • Plans: Free (limited), Individual Professional, Enterprise, Government/Research
  • Billing: Monthly or annual, in advance
  • No refunds (except as legally required or specified in enterprise agreements)
  • Price changes: 30 days' notice; applies at renewal
  • Taxes: Your responsibility (except those on our income)
  • Non-payment = suspension/termination

7. Service Availability

We strive for reliability but don't guarantee:

  • Uninterrupted or error-free operation
  • Specific uptime (except enterprise SLAs)
  • Compatibility with all systems
  • No maintenance downtime

We may:

  • Modify or discontinue features (with reasonable notice)
  • Update models or processing methods
  • Change APIs or integrations
  • Implement new security/usage limits

Service termination: 90 days' notice if we cease operations (except emergencies).


8. Privacy & Security

Security measures: Encryption (transit and rest), access controls, audits, incident response, employee training.

Privacy commitments:

  • Transparency about data use
  • User control over data
  • GDPR, CCPA, LGPD, PIPL compliance
  • Minimal retention
  • We don't sell your data

Breach notification: We'll notify you per applicable law if your data is compromised.

9. Disclaimers & Liability Limits

⚠️ Service Provided "AS IS"

NO WARRANTIES (express or implied) including:

  • Merchantability or fitness for specific purposes
  • Non-infringement
  • Accuracy or completeness
  • Error-free or uninterrupted operation

⚠️ Model Limitations

We don't control third-party AI models. Not responsible for:

  • Model errors, hallucinations, or biases
  • Model changes or discontinuation
  • Underlying model capabilities

⚠️ CRITICAL: Professional Judgment Required

DO NOT rely solely on aiBlue Core™ for:

  • Medical decisions
  • Legal advice
  • Financial transactions
  • Safety-critical systems (aviation, vehicles, industrial, life-support)
  • High-stakes governance without human oversight

Always consult qualified professionals.

⚠️ Liability Cap

Our total liability is limited to the greater of:

  • $100 USD, or
  • Amount you paid us in the past 12 months

We're NOT liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits, revenue, data, goodwill, or opportunities
  • Service interruptions or data loss
  • Third-party actions
  • Decisions based on Service outputs
  • Unauthorized account access

Applies regardless of legal theory. Some jurisdictions limit these exclusions.


10. Your Indemnification

You agree to defend and hold us harmless from claims arising from:

  • Your use/misuse of the Service
  • Your Terms violations
  • Your law violations or infringement of rights
  • Content you submit
  • Decisions you make using outputs
  • Account security failures

11. Dispute Resolution

Step 1: Informal Resolution

Contact legal@aiblue.com first. We'll work in good faith to resolve issues.

Step 2: Binding Arbitration

All disputes go to arbitration (except as noted below).

  • Conducted under AAA rules (or equivalent)

  • Decision is final and binding
  • NO CLASS ACTIONS – individual disputes only

Exceptions

  • Small claims court (if eligible)

12. International Use

Your responsibilities:

Data residency: Enterprise customers may specify geographic requirements.


13. Children & Education

General Users Under 18

  • Under 13: Not permitted (except institutional use with parental consent)
  • 13-17: Requires parental involvement and consent

Educational Use

Schools may use the Service for students under 18 with:

  • Institutional consent (acting as parent's agent)
  • COPPA and FERPA compliance
  • Appropriate safeguards and supervision
  • Educational purposes only

Child Safety

Our systems are designed to:

  • Refuse harmful requests involving minors
  • Maintain age-appropriate interactions
  • Report suspected exploitation to authorities

14. Enterprise & Government

Custom agreements typically supersede portions of these Terms and address:

  • Data sovereignty and residency
  • Security certifications
  • Service level agreements (SLAs)
  • Custom deployments
  • Regulatory compliance

15. Changes to Terms

We may modify these Terms by:

  • Notifying you via email/in-app
  • Updating the "Last Updated" date

Continued use = acceptance of changes.

Don't agree? Stop using the Service and cancel your account.

Material changes: 30 days' advance notice; may require affirmative acceptance.


16. Termination

You Can Terminate

Anytime via account settings or support@aiblue.com. Your data will be deleted per our retention policies.

We Can Terminate

Immediately, without notice, if:

  • You violate these Terms
  • Your account poses security/legal risks
  • You engage in fraud or abuse
  • Required by law
  • We cease operations

After Termination

  • Your license ends immediately
  • We may delete your data (subject to legal requirements)
  • Outstanding fees remain due
  • Certain provisions survive (IP, indemnification, liability limits, dispute resolution)
  • No refunds (except as legally required)

17. Miscellaneous

Entire Agreement: These Terms + Privacy Policy + enterprise agreements = complete agreement.

Severability: Invalid provisions modified to minimum extent necessary; rest remains in effect.

No Waiver: Our failure to enforce doesn't waive rights. Waivers must be written and signed.

Assignment: You can't assign; we can assign to affiliates, successors, or acquirers.

Force Majeure: Neither party liable for failures beyond reasonable control (disasters, war, government actions, internet failures).

Independent Contractors: No partnership, employment, or agency created.

Language: English version governs; translations for convenience only.
